A- When you register as a member on the Site, you are required to:

B- Use of our site

VODOME is not liable for any direct, indirect or consequential loss or loss of profits, goodwill or damage whatsoever resulting from the disclosure or misuse of your username and/or password. By becoming a member on the site, you consent, warrant, and acknowledge that you will:

  • Accept responsibility for all activities that occur under your account or password
  • Maintain the confidentiality of your account and password
  • Restrict access to and use of your account
  • Notify VODOME immediately of any unauthorized use of your account or any breach of security
  • Never use another member’s account at any time, without the express permission of the account holder
  • Never disclose your contact details including but not limited to phone numbers, addresses, or email addresses in commerce or listing processes, or anywhere on the site including the feedback area, discussion forum or through any e-mail feature of the site intended to bypass use of VODOME
  • Never use another user’s data for any purpose other than fulfilling a relevant transaction resulting from purchasing item(s) on the Site
  • Reimburse VODOME for any improper, unauthorized, or illegal use of your account by you or by any person obtaining access to the site through your designated username and password, regardless whether you authorized such access or not
  • Treat any other member’s information provided to you by VODOME or any other user as strictly confidential
  • Regularly update the registration data to keep it true, accurate, up-to-date, and complete. If you provide any information that is false, inaccurate, not current or incomplete or if VODOME believes that such information is false, inaccurate, not current or incomplete, or not in accordance with these Terms and Conditions, VODOME reserves the right to suspend, limit or withdraw your access to the site and/or your membership of the site. VODOME may, in its sole discretion and at any time, make any inquiries it considers necessary (whether directly or through a third party), and request that you provide it with further information or documentation, including without limitation to verify your identity and/or ownership of your financial instruments. You agree to provide any information and/or documentation to VODOME upon such requests. You acknowledge and agree that if you do not, VODOME, may, without liability, limit, suspend or withdraw your access to the site and/or your membership of the Site. We also reserve the right to cancel unconfirmed/unverified accounts or accounts that have been inactive for a long time
  • Never engage in false or fraudulent activity in connection with the use of the site. You acknowledge and consent that VODOME may suspend, limit or withdraw your access to the site and/or your membership of the site if you are found to have engaged in false or fraudulent activity in connection with the use of the site
  • Never transfer your site account (including feedback) and username to another party without our explicit consent
  • Never engage in purchasing of a product you are not legally entitled to buy for example alcohol.  In such case VODOME reserves the right, at its sole discretion and without any liability from any kind whatsoever, to refuse service, terminate accounts, remove or edit content, or cancel membership

Electronic Communications

When you use VODOME, you consent to receive communications from us electronically, including, but not limited to, emails, texts messages, messages on and through the site. You can retain copies of these communications for your records and you agree that all legal documents and communication that we provide to you electronically satisfy any legal requirement that such communications be in writing. VODOME will ask for your agreement during the registration process to send you promotional emails that let you know about new changes, features, or promotions on the site. If at any time you decide you do not wish to receive such promotional emails, you can opt out of receiving such emails by clicking on the link at the bottom of any promotional email sent by us or by sending us an email to adminlb@vodome.net

Payment by Shoppers

VODOME offers buyers the option to pay for items on the site either online or through Cash On Delivery (“COD”) or any other payment methods made available on the site at the time of posting these Terms.

VODOME merely facilitates the payments by buyers but VODOME is not involved in the process of buying and selling items on the site. All sales and purchases on the site continue to be bipartite contracts between the shopper and the vendor of an item(s) and VODOME is not responsible for any non-performance, breach or any other claim relating to or arising out of any contract entered into between any shopper and vendor, nor does VODOME have any fiduciary duty to any user. You acknowledge and agree that VODOME will hold your funds at your own risk.

Copyright

All content posted on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property of VODOME and is protected by copyright, trademarks, patents or other intellectual property rights and laws. The compilation of the content on the Site is the exclusive property and copyright of VODOME and is protected by copyright, trademarks, patents or other intellectual property rights and laws.

Trademarks

The name VODOME and the other VODOME phrases, logos, and related designs that we use in connection with our services are either registered or unregistered trademarks of VODOME and are protected by international trademark and other intellectual property rights and laws. VODOME’s trademarks may not be used in connection with any product or service that is not owned by VODOME or in any manner that may harm VODOME. All other trademarks not owned by VODOME that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by VODOME.

Gift cards can’t be returned nor can be used to purchase other gift cards on VODOME.

Return Policy for Card Payments

In the event you have settled by card, the price of the purchased item(s) and wish to issue a return order within 3 days of receiving the item(s), the price of such returned item(s) shall be returned to your bank account provided that the request claim is approved. The shopper will cover the delivery fee. However, bear in mind that the amount may take time to reflect in your card statement, depending on your card provider.

Return Policy for Promotional Items

Products purchased on sales, during a clearance or with a special offer are subject to the return policy of the vendor on VODOME.

Gift Card Terms & Conditions:

  • Gift Card is redeemable towards items sold on VODOME exclusively.
  • In order to use the gift card, you must have or create a free VODOME account.
  • Gift cards are valid for 12 months from date of receipt.
  • If your total order is less than the value of the Gift Card, the remaining amount will remain in your gift card balance to be used in following purchases.
  • If your order is more than the value of the gift card, you can make a surcharge by any means convenient for you.
  • Gift Cards may not be returned, refunded, redeemed for cash nor used to purchase other Gift Cards.
  • VODOME shall not bear any liability in case the Gift Card has been lost, stolen, destroyed or used by third parties without permission of the card owner.
  • VODOME reserves the right to void and cancel Gift Cards if a Gift Card is suspected to be obtained, used, or applied to an VODOME account fraudulently, unlawfully, or otherwise in violation of these terms and conditions.
  • The Gift Card holder shall not have the right to claim at any circumstances, and for any reason whatsoever, any indemnity, whether moral or material, from VODOME or any sister company, related to the Gift Card.

Coupon Code Terms & Conditions

  • Code is valid for a one time use. The Code applies only to items purchased in a single order;
  • Code is limited to one customer and account;
  • Each promotional Code applies only to qualifying items;
  • Code will expire depending on the set Code expiration date;
  • Code is non-transferable and may not be resold;
  • Products purchased using a promotional Code are subject to vendor’s return policy.
  • Delivery charges and taxes may apply to the full value of your order.
  • VODOME shall not bear any liability in case the Code has been lost, stolen, destroyed or used by third party without permission of the Coupon owner.
  • VODOME reserves the right to void and cancel the Coupon if it is suspected to be obtained, used, or applied to a VODOME account fraudulently, unlawfully, or otherwise in violation of these terms and conditions.
  • The Coupon’s holder shall not have the right to claim at any circumstances, and for any reason whatsoever, any indemnity, whether moral or material, from VODOME or any sister company, related to the Coupon Code.

Disclaimer

The site is only a platform where shoppers and vendors may interact with one another for their transactions. The site is not and cannot be a party to or control in any manner any transaction between shoppers and vendors of the site. The site does not provide any guarantee that a shopper or vendor will complete a transaction or accept the return of an item or provide any refund for the same. You will not hold VODOME responsible for other users’ content, action, or inaction, or items or information they list or post. By agreeing to these Terms and Conditions, you acknowledge and consent to the following conditions:

  • VODOME is not responsible for any non-performance or breach of any contract entered into between shoppers and vendors and does not transfer legal ownership of items from the vendor to the shopper. The contract for sale of any item shall be a strictly bipartite contract between the shopper and vendor. At no time shall any right, title or interest over any item vest with VODOME nor shall VODOME have any obligations or liabilities in respect of such item or the contract between the shopper and vendor.
  • VODOME is not responsible for any unsatisfactory or delayed performance, losses, damages or delays as a result of items which are unavailable.
  • VODOME is not required to resolve any dispute or disagreement between shopper and vendor or users.
  • VODOME has no control over and does not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users’ content or listings, the ability of vendors to sell items, or the ability of shoppers to pay for items.
  • VODOME does not make any representation or warranty as to the attributes (including but not limited to quality, worth or marketability) of the items proposed to be sold or purchased on the site. In particular, VODOME does not implicitly or explicitly support or endorse the sale or purchase of any items on the site, nor is VODOME a supplier or manufacturer of any items sold by vendors or purchased by shoppers.
  • VODOME does not make any representation or warranty as to the attributes (including but not limited to legal title, creditworthiness, or identity) of any of its users.
  • The site may include links to third party websites that are controlled by and maintained by others. VODOME cannot accept any responsibility for the materials or offers for goods or services featured on such websites and any link to such websites is not an endorsement of such websites or a warranty that such websites will be free of viruses or other such items of a destructive nature and you acknowledge and agree that VODOME is not responsible for the content or availability of any such sites.
  • Users shall independently agree upon the manner and terms and conditions of delivery, payment, and insurance as between each other and VODOME holds no responsibility in respect of such arrangements.
  • VODOME accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
  • VODOME excludes all implied warranties, terms and conditions and is not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising directly or indirectly, out of your use of or your inability to use the Site.
  • You release and indemnify VODOME and/or any of its officers and representatives in respect of any claim, demand, dispute, cost, damage, liability or other consequence (direct or indirect) of any of the actions of the users of the Site and you specifically waive any claims that you may have in this respect under any applicable law.

Username and Password

To access your account or make a transaction on the Site, you must enter your username and password. Choose your password carefully using a combination of numbers, special characters, and lower-case and upper-case letters. Remember to change your password frequently and be careful not to share your username and password with anyone. If you are concerned that your password has been compromised, change your password immediately by logging to the My Account section of the Site.

Breach of User Agreement

In connection with your use of the site, you will not breach these Terms & Conditions. If you do, VODOME may immediately and without liability limit your activity, terminate your membership on the site indefinitely or temporarily, end your listings, and/or warn other users of your actions.

VODOME may at any time and in its sole discretion reinstate suspended users. A user that has been indefinitely suspended or had their membership withdrawn may not register or attempt to register with VODOME or use the site in any manner whatsoever until such time that such user is reinstated by VODOME. Notwithstanding the foregoing, if you breach these Terms & Conditions VODOME reserves the right to recover any amounts due and owing by you to VODOME or any losses and damages caused by you to VODOME and to take such steps, including legal action and/or the initiation of criminal proceedings against you, as VODOME in its sole discretion deems necessary.

Providing Feedback

Shoppers on the site can provide reviews on vendors store page after a transaction has closed. Your feedback will be displayed along with your user ID on the site. You cannot withdraw the review once you have posted it on the site. VODOME will not be liable for the review that you post on the site. If you continuously receive negative review ratings, VODOME reserves the right to suspend, limit or withdraw your access to the site and/or your membership of the site. You acknowledge and agree that you shall not market or export your VODOME review rating to any third party other than on the site.

Withdrawal of Access and/or Membership

VODOME may limit, suspend or withdraw your membership and / or your access to the site at any time, without notice, for any reason, including, but not limited to, breach of this Agreement.

Warranties

All information, content, materials, products, and services included on or otherwise made available to you through the site are provided by VODOME on an “as is” and “as available” basis, unless otherwise stated in writing. VODOME makes no representation, endorsements, or warranties of any kind, express or implied, as to the accuracy, reliability, or completeness of any content on the site or the operation of the site or the information, content, materials, products, and services included on or otherwise made available through the site unless otherwise specified in writing. You expressly agree that your use of the site is at your own risk and that VODOME has no obligation to offer support for the site.

Limitation of Liabilities

The vendors whose items are available on the Site for sale are independent suppliers and are not employees of VODOME. In no event shall VODOME be liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any vendor, for any personal injuries, death, damage, or losses of profit, goodwill, data, information, and other intangible losses resulting from a direct or indirect connection with your use of the site, or costs resulting therefrom. You acknowledge and agree that you are fully responsible for your use of the site. You acknowledge and agree that any information you send or receive during your membership and/or use of the site may not be secure and may be intercepted by unauthorized parties. You acknowledge and agree that your use of the site is at your sole risk and that the site is made available to you at no charge. Recognizing such, you acknowledge and agree that, to the fullest extent permitted by applicable law (including, without limitation, consumer protection law), VODOME will not be liable for any direct, indirect, punitive, exemplary, incidental, special, consequential or other damages arising out of or in any way related to (a) this site, or any other site or resource you access through a link from this site; (b) any action we take or fail to take as a result of communications you send to us; (c) your VODOME membership, any termination or cancelation of your membership; (d) any products or services made available or purchased through the site, including any damages or injury arising from any use of such products; (d) any delay or inability to use the site or any information, products or services advertised in or obtained through the site; or (e) the modification, removal or deletion of any content submitted or posted on the site. If you are dissatisfied with the site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it.

Indemnity

You agree to defend, indemnify and hold VODOME and its stakeholders (owners, employers, investors, users, buyers, partners, and other sellers) harmless from and against any and all claims, damages, costs, actions, losses, liabilities, and expenses including legal expenses and attorney’s fees, arising from or related to your use of the Site and/or your breach of any representation, warranty, or other provision of the Terms & Conditions or your violation of any law or the rights of a third party.

No Partnership or Agency

Nothing in this Agreement shall be deemed to constitute a partnership or agency in law between you and VODOME and you shall have no authority to bind VODOME in any manner.

Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of Lebanon. Any dispute, claim or controversy arising out of or in connection with these Terms & Conditions (including a dispute, claim or controversy relating to any non-contractual obligations arising out of or in connection with these Terms & Conditions) shall be referred to the parties’ respective officers for resolution. If any dispute remains unresolved 14 days after being referred to the officers, it shall be finally settled by one arbitrator appointed in accordance with the rules of conciliation and arbitration of the Lebanese law. The seat, or legal place, of arbitration shall be Metn. The language to be used in the arbitration shall be English. The award shall be final and binding and the parties hereby waive any right they may have to appeal such award. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction against any matters relating to intellectual property rights.

Transfer of Rights and Obligations

You hereby grant VODOME the right to, and irrevocably acknowledge and agree that VODOME may at any time, transfer all or any part of its rights, benefits, obligations or liabilities (whether express or assumed) under these Terms & Conditions to any of its affiliates without requiring your further specific agreement. VODOME agrees to use all reasonable endeavors to provide notice to you of any transfer by way of a posting on the Site. You may not at any time, without the prior written consent of VODOME, transfer all or any part of your rights, benefits, obligations or liabilities (whether express or assumed) under these Terms & Conditions without the prior written consent of VODOME.

Warranty Information

Warranties for products offered on VODOME are covered directly by the vendor. If the product is covered by warranty, it will be mentioned in the description of the item on VODOME and warranty conditions will apply according to the vendor’s warranty terms and conditions.

Amendments to These Terms & Conditions

VODOME reserves the right to make changes to the Site, policies, and these Terms & Conditions at any time without your prior consent and with immediate effect by posting a notice of the amendment on the Site. VODOME will notify you of any amendment to these Terms and Conditions that materially increases your obligations or decreases your rights in accordance with the terms of these Terms & Conditions.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and VODOME with respect to the subject matter hereof.
